Terms of Service

These Terms of Service ("Terms") govern your use of the Cadence mobile application ("Cadence", "the app"), a product of Bitwiz ("Bitwiz", "we", "us", "our"), an independent developer based in Bangalore, Karnataka, India. By downloading, installing, or using Cadence, you agree to these Terms. If you do not agree, do not use the app.

1. The service

Cadence is a sales power-dialer and call-tracking tool for Android. It helps you work through a list of contacts, place calls from your device, log outcomes and notes, and view your own call history and analytics. Cadence is a tool; you are solely responsible for how you use it and whom you call.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Cadence.

3. Accounts

To use the paid features you sign in with your email via a one-time code. You are responsible for maintaining access to your email and for all activity under your account. Sharing one account across multiple people or devices does not increase your plan limits (see Section 5) and may lead to suspension (Section 9).

4. Subscriptions and billing

  • Cadence offers paid plans: Starter, ₹499/month or ₹4,999/year (250 dials per day) and Pro, ₹799/month or ₹7,999/year (400 dials per day). An Enterprise plan is planned.
  • Payments are processed by Instamojo. By subscribing you also agree to Instamojo's terms. Prices are in Indian Rupees and inclusive of applicable taxes unless stated otherwise.
  • Access is granted for the period you pay for. You may cancel at any time; see the Refund & Cancellation Policy at https://cadence-b9n.pages.dev/refund.html.
  • We may change prices or plans; changes apply to future billing periods and will be reflected in the app and on our website.

5. Fair use and limits

Each plan includes a per-day auto-dial limit enforced per account across all devices. Attempting to bypass limits, share a single account among many users, or otherwise abuse the service is prohibited.

6. Acceptable use: your responsibility for calls

You agree to use Cadence lawfully and to comply with all applicable laws and regulations, including India's telecom and unsolicited-commercial-communication rules (e.g. TRAI regulations and DND/DLT requirements). You are solely responsible for having the necessary consent and legal basis to contact the numbers you dial. You must not use Cadence for spam, harassment, fraud, or any unlawful, deceptive, or abusive calling. Bitwiz is not responsible for the calls you make or their consequences.

7. Your data

Cadence keeps your contacts, calls, notes and analytics on your device; we do not upload them. Our handling of the limited account data we do process is described in our Privacy Policy at https://cadence-b9n.pages.dev/privacy.html.

8. Intellectual property

Cadence, its name, logo, and software are owned by Bitwiz. We grant you a limited, non-exclusive, non-transferable licence to use the app for its intended purpose. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

9. Suspension and termination

We may suspend or terminate your access, including remotely blocking an account or requiring an app update to continue, if you breach these Terms, abuse the service, or where necessary to protect the service or other users. You may stop using Cadence at any time.

10. Disclaimers

Cadence is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that calls will connect or complete. Call delivery depends on your device, carrier, and network.

11. Limitation of liability

To the maximum extent permitted by law, Bitwiz will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or business, arising from your use of Cadence. Our total liability for any claim relating to the service will not exceed the amount you paid us in the three (3) months before the claim.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of Cadence after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
